    Act 1 prevents unmarried or cohabitating couples from adopting or fostering children in Arkansas. It passed on November 4th.

    Some voters say they were confused by the wording on the ballot. The wording can be a little tricky. Vote yes if you don’t want unmarried couples to be allowed to adopt, vote no if you do.

    “Today we have been hearing from a lot of people around all different parts of the state saying that they thought by voting “yes” that they were voting against the ban,” explains Jennifer Ferguson, the Deputy Director for AACF.

    Act 1 supporters are saying vote totals don’t lie.

    “I don’t think 57% of the voters were confused about Act 1. They understood what it was about. They went out and voted for it. That’s a convincing win,” says Jerry Cox, President of Family Council.

    Not good enough, according to a group called “Advocates for Arkansas Children and Families,” especially since they think this act will hurt children in need

    “There’s a shortage of foster care homes, and just by passing blanket rules like this, it bans potentially good homes,” says Ferguson.

    Now the group is talking about what they can do to get the act overturned.

    “Over the next few weeks, we’ll be looking more specifically at a legal challenge,” explains Ferguson.

    That’s something the family council isn’t too worried about.

    “We spent nearly six months working with lawyers to craft a very good proposal because we felt that if we didn’t that our opposition would indeed challenge the measure if it did pass,” explains Cox.
