The jury began deliberating around 10:30 Friday morning and a little after 3pm a verdict was reached. Wayne Fincher was found guilty on both weapon possession charges.
Wayne Fincher, a member of the Washington County Militia was found guilty of possessing a machine gun and possessing a sawed off shotgun.
Throughout this trial the jury was taken in and out of the courtroom many times while issues, like the second amendment, were discussed. Prosecutor Wendy Johnson said Judge Hendren analyzed case law all they back to the 1900`s.
Oscar Stilley, Finchers attorney, said justice wasnt served. Fincher himself wasnt allowed to take the stand with the jury present because the judge ruled his testimony challenging the legality of federal gun laws.
Stilley says they plan on appealing, taking it all the way to the US Supreme Court if necessary
Fincher wont be sentenced for at least another two months. He is facing a maximum punishment of 20 years.
