On Monday in Fayetteville, a hearing to decide whether to dismiss a lawsuit against the University of Arkansas produced results. Four of the four counts listed in plaintiff John David Terrys lawsuit against the university were dismissed today by Judge Mark Lyndsey. The judge said he did not have jurisdiction to rule over two of the counts and therefore was forced to throw them out and he added that attorneys for the plaintiff failed to properly argue two of the counts and therefore he was forced to dismiss those as well. However, attorney Eddie Christian Jr. was goven the opportunity to "re-plea" those counts. As council for John David Terry, Christian has twenty days to gather more affirming information concerning the accounts. He gave no comment immediately following Mondays hearing, so no word on whether hell accept the courts decision or if he will, in fact, re-plea those counts.
