The family of a Springdale man shot to death in Madison County demands answers as to why the alleged shooter remains free. The incident occured on Wednesday leaving Melvin Burks Jr. dead and his accused killer home within hours.
His family wants answers from the Washington County Prosecuting Attorney and they`re looking for justice.
Misty Burks, Wife: "He died too young he`ll never get to see his babies grow up, never get to walk his girls down the aisle."
Misty and Melvin Burks spent 10 years together, building a family that includes three small children.
Burks: "I get to say goodbye to my husband this evening. She gets to do whatever she wants. She gets to walk the streets while I had to pick out a coffin yesterday and the clothes that he was going to be buried in."
Lisa Ann Rivers has been charged with 2nd degree murder for allegedly firing a bullet into Burks chest. She claims the death was an accident. And Washington County Prosecutor Terry Jones let Rivers go, on her own recognizance, saying she isn`t a flight risk because she`s caring for her young daughter and ill grandfather. While others were making funeral arrangements, Rivers was home Saturday hanging laundry and went in quickly when KNWA arrived. She asked us to leave the property.
But the public isn`t buying it. Madison County Sheriff Phillip Morgan says he`s received over 50 calls from people wondering why Rivers is home and not in jail.
Sheriff Phillip Morgan: "Usually when someone`s been charged with this type of crime they`re locked up."
And the Burks family is asking the same question.
Kimberley Burks Burnette, Sister: "I can`t understand how he could let her out, no bail, no bond, no nothing. Why is she anymore special than the rest of us? Me and my parents feel lost."
Terry Jones could not be reached for comment on Saturday. Rivers arraignment is set for February 14th in Madison County Circuit Court.
