Ken Swindle filed suit on Tuesday against the Rogers School Board and Northside Elementary School Principal Anita Turner.
Swindle said he is fighting for his son Jordan who was given one day of in-school suspension after saying the f-word at school.
Swindle said the five-year-old has the right to a jury trial.
The Rogers' School Board unanimously upheld the boy's punishment, but Jordan's dad wants the punishment erased from his record.
