A lawsuit against the the Chancellor and President of the University of Arkansas is heating up with a response from the plaintiffs attorney.
John Terry is suing University Officials for not doing their job after a football player received a critical email. The University filed a motion to dismiss this lawsuit earlier this month. On Tuesday, Terrys attorney filed a response.
In the response, Terrys attorney Eddie Christian Jr. states that the court must review the complaint of John David Terry and assume that all the alleged facts are true.
Christian states this case is best characterized as a public funds exaction case. Terry claims Chancellor White and other state employees have and are failing to carry out their jobs as required under their contract of employment.
According to the response, Terry as a taxpayer has the right to bring an action against public officials who are not performing their public duties. Terry claims White failed to take timely and appropriate action through questions, or an independent investigation into the critical email sent to Mitch Mustain. So according to the response, White breached his obligation to Arkansas taxpayers.
A hearing is scheduled for Monday June 4, at the Washington County courthouse where a judge will look over the Universitys request for a dismissal and the plaintiffs response.
