ATV Accident Brings Wrongful Death Suit

An ATV accident that occurred in May of last year is now the subject of a wrongful death suit filed in Benton County Circuit Court on Monday. The suit claims that a Siloam Springs man is responsible for the death of an eleven year old boy because the man didnt do enough to prevent the child from operating the four-wheeler...leading to the boys death. On May 29, 2006 Ashton Blayne Potter drove the vehicle up an embankment causing it to roll over and crush him. The boys mother, Mandi Lopez says Donald Main should have taken better precautions to ensure minors couldnt harm themselves on the ATV that Main used for his cement business. Neither party could be reached for comment on Tuesday.
