When we spoke to Jose Nunez on Monday he was incensed. He said he was arrested on a domestic battery charge, but he was held far after that charge was taken care of for being an illegal immigrant. A mistake, according to police, that began during the booking process. The wife of Nunez, swore out a warrant for her husbands arrest....but when she did, she gave them the wrong date of birth. A tell tale sign immigration enforcement keeps an eye out for because most illegal immigrants give false information when arrested. The man had to be held until that information could be sorted out by Immigration and Customs Enforcement but that agency is closed on weekends. Recently federal authorities told local police agencies to combine their efforts in immigration enforcement...but until they do theres no way of telling how that would have affected such a simple mistaken identity case that kept a man jailed longer than necessary.
