According to Stephens, he was fired after he asked the towns mayor to return former police equipment.
"The mayor told me if thats how its going to be you need to turn your stuff in and I was in shock. I said what? and he said If that is how its going to be, turn your stuff in. Youre fired" said Ryan Stephens.
Stephens Attorney, Kevin Ridgley, filed a wrongful termination lawsuit and filed a request for a jury trial.
"Thats what I hope the judge says youve got a cause of action and Im not going to decide it for you. You deserve to let a jury decide this for you" said Kevin Ridgley.
This is not the first time a Huntington police officer sued for wrongful termination.
Former Police Chief, Robert Mikles, filed a lawsuit in 2004 for wrongful termination and won .
Mikles says its not the mayor whos causing the problems.
"The mayor tries to be progressive and do things the right way down there and their city council tries to rule, they try to tell the Police Department what to do and theyre not police officers" said Robert Mikles.
Huntington is still down to one police officer.
